Supreme Court's strict directive to complete trials within three months

The Supreme Court of India today heard the bail plea of renowned cleric Maulana Abdul Rehman Katki, who has been accused of having links with the banned terrorist organization Al-Qaeda. During the hearing, senior advocate Nitya Ramakrishnan, representing the accused, informed the court that Katki has been in jail for over 10 years and despite the high court's orders to expedite the trial, it has not been completed yet. Additionally, Katki has already served the seven-year sentence he received in the Delhi case three years ago.

Additional Solicitor General of India, Natarajan, strongly opposed Katki's bail, stating that the accused has been charged with serious offenses, including terrorism, and granting him bail could disrupt the peace. The prosecution requested the Chief Justice to direct the trial court to expedite the hearing instead of granting bail.

Meanwhile, senior advocate Nitya Ramakrishnan, representing the Jamiat Ulema-e-Maharashtra (Arshad Madani) Legal Aid Committee, informed the court that out of the witnesses presented against Katki, 20 have retracted their statements. Despite this, Katki is being forced to remain in jail.

After hearing the arguments, Chief Justice of India, Justice Surya Kant, stated that although serious charges have been leveled against Katki, it does not mean that the trial should not be expedited. The court decided not to grant bail but instead directed the trial court to complete the hearing within the next three months. The court also ordered that no adjournments would be allowed during this period.

The court further directed that the trial court would only hear Katki's case on the designated days and no other cases would be heard on those days. The Chief Justice of India also instructed the Chief Justice of the Orissa High Court to transfer other cases from the judge hearing Katki's case to another court, allowing the session court to focus on Katki's trial.

The Chief Justice of India also directed that witnesses who cannot appear in person due to any reason would be allowed to testify via video conferencing. Additionally, the session judge has been instructed to hear Katki's case even during summer vacations and can take a break only after completing the hearing.

The Supreme Court has allowed Katki to approach the Orissa High Court for bail if the trial is not completed within the specified timeframe. This is the sixth time the Chief Justice of India has heard Katki's bail plea in the past three months.

Reacting to today's court proceedings, President of Jamiat Ulema-e-Maharashtra, Maulana Halimullah Qasmi, stated that they had hoped Katki would be granted bail this time. However, the Chief Justice of India has instead directed the trial court to expedite the hearing. Qasmi expressed hope that the trial would be completed within the next three months, and Katki would receive justice.

It is worth noting that separate cases have been filed against Katki in Delhi, Jamshedpur, and Cuttack. Katki was sentenced to seven and a half years in the Delhi case, while he was acquitted in the Jamshedpur case. Katki has been charged with serious offenses, including being a member of Al-Qaeda, conspiring to carry out terrorist activities in India, and receiving training abroad illegally. The Jamiat Ulema-e-Maharashtra Legal Aid Committee has been following Katki's cases for the past 10 years.
